NOTICE: Please read these terms and conditions carefully.

Jozi Music CC trades under the name of "Just Music" and will hereinafter be refered to as "Just Music"

They set out the terms and conditions upon which the Just Music website, Services, Record Company Partners and portals ("Just Music") are made available to you. By accessing Just Music You agree to be bound by the terms and conditions set out below and as amended from time to time in accordance with clause 7.3 of these terms and conditions. If You do not wish to be bound by these terms and conditions, You may not access or use Just Music and should exit Just Music immediately. (If You are under 18 (eighteen) then Your parent or guardian should read and accept these terms and conditions before You access or use the site and its spin-off products).

Definitions

Within these terms and conditions the words "You/Your" shall mean You the user and the words "We/Us" shall mean Just Music and any associated company or subsidiary, including but not limited to all other members of the Just Music gropup of companies, and where appropriate any technology partners or suppliers and entertainment partners. "Services" means the content, search facilities, directory Services, personal Web space, email, newsgroups, SMS and other messaging Services and other Services provided by Us or on Our behalf. "Just Music" means the Website operated by Us and through which You may access the Services. "Contact Details" means Your name, address (whether at work or at home), e-mail address and telephone numbers (whether mobile, work or home). "User Information" means the details provided by You either on registration or when participating in competitions or by use of the Services. "Users" means the users of the Services collectively; "Cookies" means standard Web tracking devices as described in clause 11 of the Privacy Policy (see below).

• 1. Your Personal Information

  • 1.1. We respect Your personal information and undertake to comply with applicable local legislation.
  • 1.2. You should be aware that:
    • 1.2.1. if We are requested by the police or any regulatory or government authority investigating suspected illegal activities to provide Your User Information and/or information concerning Your activities whilst using the Services We shall do so. Similarly, We will disclose Your User Information and/or details of Your use of the Services if We are compelled to do so by law;
    • 1.2.2. In relation to the personal information provided by You, You agree that Just Music may pass Your User Information or details of Your use of Just Music and the Services to other companies in the same corporate group as Just Music and selected third parties (such as, but not limited to, other businesses in the music and entertainment industry) for analysis and/or to enable them to contact You about products or Services or information which may be of interest to You. Such use will be in accordance with Our Privacy Policy.
    • 1.2.3. We may deposit Cookies on Just Music's and other Websites which may be accessed by You and those Cookies may provide Us with information regarding Your use of the Internet and any personal information provided by You on those Websites.
    • 1.2.4. We reserve the right in Our reasonable discretion to disclose details of Your Use of the Services to a person who makes a complaint or allegation in connection with Your use, or the use of anyone under Your control, of the Services whether in connection with the matters set out in clause 6 of these terms and conditions or otherwise. We reserve the right to disclose Your Contact Details and details of Your use of the Services in such circumstances whether or not We are named as a party or a witness in any threatened or pending legal proceedings.
    • 1.2.5. You must complete the registration process by providing Us with true, accurate and current information as prompted by the registration form. You must choose a password. You are then entirely responsible for maintaining the confidentiality of Your password and account.
    • 1.2.6. Just Music and any associated companies have the right to suspend or terminate Your account and refuse any and all current or future use of the Service.
    • 1.2.7. Registered Users have the right to unsubscribe from Just Music Services at any time as detailed in clause 7.4 of the Privacy Policy.

• 2. Disclaimer of Warranties

  • 2.1. Just Music and the Services are provided on an "as is" and "as available" basis and We make no warranties or representations, whether express or implied, in relation to Just Music or the Services, including but not limited to, implied warranties or conditions of completeness, accuracy or currency.
  • 2.2. To the extent permitted by law We make no warranty that Just Music or the Services will meet Your requirements or will be uninterrupted, timely, secure or error-free.
  • 2.3. To the extent permitted by law We give no warranty as to results or the accuracy of any information obtained through Just Music or the Services.
  • 2.4. To the extent permitted by law We make no warranty regarding any goods or Services purchased or obtained through Just Music or any transactions entered into through Just Music.

3. Limitation of Liability 3.1. Nothing in these terms and conditions shall exclude or limit liability for death or personal injury resulting from Our negligence or that of Our servants, agents or employees or any other liability which is prohibited from being excluded by law. 3.2. You acknowledge that We have no control over the information which can be accessed by using Just Music and the Services and that We do not know or examine the use to which You or other Users put the Services or the nature of the information You or other Users are sending or uploading. Subject to Clause 3.1 of these terms and conditions, We therefore exclude all liability of any kind for the transmission or reception of such information of whatever nature by or to You. 3.3. Subject to Clause 3.1 of these terms and conditions: 3.3.1. We exclude all liability of any kind for the information or any other material published or otherwise made available by You or any other User or person on any Web site You establish using the Services; and 3.3.2. We shall not be liable in contract, tort, negligence, or otherwise, for any loss or damage whatsoever arising from or in any way connected with Your use of Just Music or the Services or accessing other websites from Just Music, including, without limitation, damage for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary loss (even where We have been notified by You of the possibility of such loss or damage). 4. Registration 4.1. You warrant that: 4.1.1. the User Information which You are required to provide when You register as a User of Just Music is true, accurate, current and complete in all respects; and 4.1.2. You agree to notify Us immediately of any changes to the User Information by updating Your profile or emailing: changes@justmusic.co.za. 4.2. You agree not to impersonate any other person or entity or to use a false name or a name that You are not authorised to use. 4.3. Subject to Clause 14 of these terms and conditions, We reserve the right to terminate Your account (including User name and password) and to re-use any e-mail or other communication address issued to You by Just Music. 5. Your Obligations 5.1. You: 5.1.1. are responsible for procuring the necessary equipment and the payment of telephone charges necessary to access and use the Services; 5.1.2. accept responsibility for any content You transfer through Just Music and/or the Services (including, but not limited to, email, Web pages, newsgroups or chat Services); 5.1.3. agree to use Just Music and/or the Services only in accordance with all relevant laws and not for any illegal purpose; 5.1.4. agree not to use Just Music and/or the Services to distribute by any means computer viruses, macro viruses, trojan horses or worms to third parties; 5.1.5. agree not to use Just Music and/or the Services to transmit or post any material which is defamatory, offensive, or of an obscene or menacing character, or in such a way as to cause annoyance, inconvenience or needless anxiety; 5.1.6. agree not to use Just Music and/or the Services such that You cause the whole or part of Just Music and/or the Services to be interrupted, damaged, rendered less efficient or to in any way impair effectiveness or functionality of Just Music or the Services; 5.1.7. agree not to use Just Music and/or the Services in any manner which constitutes a violation or infringement of any person, firm or company or its rights (including, but not limited to, third party intellectual property rights or confidentiality);
